. WorkTech Terms & Conditions 2022 Please read our terms and conditions carefully before using our service. The following terms and conditions govern your use of WorkTech and provide information about WorkTech’s services. You agree that by accessing the website https://www.work-tech.co.uk, you have read, understood, and agreed to be bound by all these terms and conditions. These Terms and Conditions apply in full force and effect to your use of this website, and the use of this website constitutes an express agreement with all the terms and conditions contained herein in full. Do not continue to use this Website if you have any objection to any of the Terms and Conditions stated on throughout the following document. Requirements from all users: Our services are not available to anyone who is legally classified as a minor, to any persons under the age of 18 years old. WorkTech’s services are strictly for the use of individuals, corporate or other entities who are legally able to bind contracts under applicable law. Requirements from Engineer: All WorkTech engineers must pass verification prior to their account being activated. Once an account is verified (“Verified”) and activated, the account holder (“Engineer”) will have full access to the details of jobs that they have accepted on the WorkTech Platform. Using our services warrants that you have all the essential insurances in place to the full extent required for the services you provide and that they are always up to date. Engineers agree to: • Provide accurate information to complete all required vetting checks throughout duration of the engineers account held with WorkTech • Hold valid, up to date Public Liability Insurance throughout the time of using WorkTech’s services, if an engineer’s policy is not up to date this will be shown on their profile page. It is up to the engineer to submit updated / renewed certificates of their insurances. If insurance certificates, such as public liability; is not renewed and has reached its expiry date, WorkTech will freeze the engineers account with immediate effect. • Provide proof of a government issued ID (e.g.: Passport or Drivers Licence) • Provide updated copies of documents that were provided initially to complete vetting checks when they have reached expiry or if details have changed due to external circumstances. This means an updated copy of liability insurance when it is renewed and any other form of information / documentation that renews (e.g.: Drivers Licence, which would have been provided as form of ID in the initial vetting checks for the account to open) • Inform WorkTech of any changes to the business, including change of ownership, legal status or address • Only complete accept jobs that falls within their professional competence and supply proof of accreditation where legally obliged to hold • Inform us of any changes to the business, including change of ownership, legal status or address • Inform us of any personal changes; change of home address, legal name change Should any of the information / documentation provided found to be false / falsified, WorkTech obtains the right to indefinitely suspend the engineers account and all use of the site and services and report to relevant authorities. Communications: We have put the following guidelines in place to help support all our engineers when communicating with WorkTech and the clientele. Engineers agree to: • Provide honest and realistic information about skill sets, abilities and work dates • Inform WorkTech Head Office via email, website chat or phone if they are unable to carry out agreed works, to enable WorkTech head office to locate an alternative • Keep to all appointments booked and to the time agreed. If they are unable to make the original time or date, they must contact WorkTech to try to re- schedule or cancel the job • Respond to all customer communications and contact in a professional, timely manner Wholesalers agree to: • Provide clear and concise information of the client’s requirements for the installation and of the clients details: contact information and address. Resolving issues: In the unlikely event that things don’t go to plan on a job, WorkTech offers a comprehensive support from our in-house team of engineers that have been in the field for over thirty years to provide you with competent advice. In more elaborate cases, WorkTech will send an inhouse engineer out to you, to offer you a helping hand. WorkTech is able to communicate with yourselves and the client in question, with the aim to resolve any issues which cannot be directly solved between you; giving you extra peace of mind. Engineers agree to: • Contact WorkTech immediately if any problems arise on the job, whether this is a technical / labour issue with the installation or miscommunication arising with the client • Contact WorkTech if, under any circumstance, additional work needs to be carried out whilst at the job. This includes supply of cables, cable concealing, socket installation, bracket supply, additional set ups or mounts. For example, Sound bar installation. WorkTech agrees to reimburse the user for any materials supplied at a job that was not stated in the original job description. If WorkTech is not informed of additional work or supplies for a job whilst the engineer is at the job, WorkTech may not reimburse the engineer for any extra materials supplied on the job as the client would have not been charged accordingly. If you have any reason to complain about the work of a WorkTech employee, please contact WorkTech Head Office. Payment: WorkTech will pay the engineer / wholesaler on the same day as the job is completed, unless otherwise negotiated between WorkTech and engineer / wholesaler. Engineers agree to: • Before or during works, agree in writing any changes to the agreed quote/contract value prior to the work/additional work being completed with WorkTech Head Office • The engineer agrees to not discuss pricing with the client • The engineer agrees to not undercut WorkTech, convince the client to cancel the job with WorkTech and take the job for themselves • Full payment will not be made to the engineer until work is completed and payment must not be demanded from the client as the work is already paid for If any of the aforementioned in the payment section is breached by an engineer, their account will be terminated with immediate effect and will receive an indefinite ban from using our services. All engineers require to ensure that any of their legal and tax filings, including VAT are not in violation of any applicable laws. All relevant self-employed taxes and documents that are required by any governmental body, are filed, and paid promptly. Accepting Jobs: When a job is accepted by an engineer through WorkTech, the engineer is obliged to complete the job within the timescales provided. The engineer may not assign, subcontract any job they have accepted through the Site unless i) the subcontractor is already verified and approved by WorkTech ii) WorkTech is notified. User Relationship: You and WorkTech are independent contractors. No agency, partnership, joint venture, employee- employer or franchiser-franchisee relationship is intended or created by this User Agreement. All Engineers and Wholesalers work on a self-employed basis at all times. Engineers agree NOT to: - File employment or unemployment related claims against WorkTech under any circumstance(s). GDPR: We respect your privacy rights and provide you with reasonable access to the Personal Data that you may have provided through your use of the Services. If you wish to access or amend any other Personal Data we hold about you, or to request that we delete any information about you that we have obtained, you may contact us at info@work-tech.co.uk. At your request, any reference to you, we will have deleted or blocked in our database. You may update, correct, or delete your Account information and preferences at any time by accessing your Account settings page on the WorkTech Site. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. You may decline to share certain Personal Data with us, in which case we will not be able to provide to you the main features and functionality of the WorkTech Site, aka: access and visibility of jobs and clients details. In order to prevent fraud and protect our clients and wholesalers we must receive a copy of a government issued photo ID (i.e. passport or drivers license) before jobs can be visible to you. You may black out your ID number. Rest assured that we will protect the image and documentation that you send us. Your ID file is encrypted from the time that it leaves your computer. It is stored in an encrypted state on our servers and can only be viewed by our administrative team. Registration, Password and Security: Our Site requires the engineer to register or open an account. The engineer will be asked to choose a password. Please select a password that would not be obvious to someone trying to guess your password. Change your password regularly as an added precaution. You, the engineer, are responsible for maintaining the confidentiality of the password and account, and you are fully responsible for all activities that occur under your password or account identification. The Engineer agrees to: • Immediately notify WorkTech of any unauthorised use of thier password or account or any other breach of security Without limiting any rights which WorkTech may otherwise have, WorkTech reserves the right to take any and all action as it deems necessary or reasonable, to ensure the security of the Site and your account, including without limitation terminating your account, changing your password, or requesting additional information to authorise transactions on your account. Notwithstanding the above, WorkTech may rely on the authority of anyone accessing your account or using your password and in no event and under no circumstances shall WorkTech be held liable to you for any liabilities or damages resulting from or arising out of (I) any action or inaction of WorkTech under this provision, (II) any compromise of the confidentiality of your account or password and (III) any unauthorised access to your account or use of your password. You may not use anyone else's account at any time, without the permission of the account holder. The security of your personal identifying information is important to us. While there is no such thing as "perfect security" on the Internet, we will take reasonable steps to help ensure the safety of your personal identifying information. However, you understand and agree that such steps do not guarantee that use of the Site is invulnerable to all security breaches, and that WorkTech makes no warranty, guarantee, or representation that use of any of our Site is protected from viruses, security threats or other vulnerabilities. Software Updates: We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We also have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site. We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms and Conditions will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith. Termination of Account: If you no longer wish to have an account, you may terminate your account by sending an email to info@work-tech.co.uk. If you no longer accept these terms and conditions, or any future modification to these terms and conditions, you must cease using the WorkTech Site. Continued use of the WorkTech Site indicates your continued acceptance of these terms and conditions. If, for any reason, we believe that you have not complied with these terms and conditions, we may, at our sole discretion, cancel your access to the registration areas of WorkTech Site immediately and without prior notice. We may terminate your registered account, at our sole discretion, by emailing you at the address on your account stating that the agreement has terminated. If we are unable to verify or authenticate any information and / or documents you provide to us and / or believe that your actions may cause any loss or damage to WorkTech or the Clientele, your account will be terminated with immediate effect.
