WorkTech Platform Terms of Use & Privacy Notice For all users of the WorkTech platform: partners, authorised users, engineers, and installation customers. Part A sets out the terms that apply to everyone who uses the WorkTech platform, with sections specific to each type of user. Part B is our privacy notice, explaining how we handle personal data for each type of user under UK data protection law. Commercial subscription terms for business partners are set out separately in the WorkTech Terms & Conditions and any Order Form. Part A — Platform Terms of Use 1. Who these terms apply to These terms apply to everyone who accesses or uses the WorkTech platform at work-tech.co.uk, the WorkTech engineer application, and related tools (together, the "Platform"). The Platform is operated by WorkTech Global Limited ("WorkTech", "we", "us"). They apply to four types of user: • Partners — retailers, manufacturers, and installation businesses with a commercial agreement with WorkTech; • Authorised Users — individuals given a Platform account by a Partner or by WorkTech; • Engineers — independent installation professionals engaged by WorkTech to complete jobs through our managed network; • End Customers — people receiving an installation arranged through the Platform. By using the Platform you accept these terms. If you use the Platform on behalf of a business, you confirm you have authority to bind that business. 2. Accounts and security (all users) You must provide accurate information when creating or maintaining an account, keep your login credentials confidential, and not share your account with anyone else. You are responsible for activity under your account. Tell us immediately at info@work-tech.co.uk if you suspect unauthorised access. We may suspend an account to protect the Platform, investigate misuse, or where required by law. 3. Acceptable use (all users) You must not: use the Platform for any unlawful purpose; upload malicious code or attempt to gain unauthorised access to any system or data; access data belonging to another organisation or person without permission; copy, scrape, decompile, or reverse engineer the Platform except as permitted by law; use the Platform to build or support a competing service; or interfere with the Platform's operation or security. We may remove content and suspend or terminate access for breach of this section. 4. Terms for Partners and Authorised Users Partners' commercial rights and obligations — including fees, subscription terms, service levels, and liability — are set out in the WorkTech Terms & Conditions and the applicable Order Form. In addition, when using the Platform: Partners must ensure their Authorised Users comply with these terms; job and customer information submitted must be accurate and lawfully obtained; and each organisation's users can access only that organisation's data through role-based permissions. Partners are responsible for their own engineers when using the SaaS workforce management product; WorkTech provides software only in that context. 5. Terms for Engineers 5.1 Independent contractor status. Engineers are engaged by WorkTech as independent contractors. Nothing in these terms or in the acceptance of any job creates an employment relationship, partnership, or agency between an Engineer and WorkTech or any Partner. Engineers are responsible for their own tax, National Insurance, and business affairs. 5.2 Eligibility and vetting. Engineers must complete our vetting process, which includes identity verification, proof of appropriate insurance (including public liability cover at the level we specify), and evidence of relevant skills or certifications. Engineers must keep these current and notify us of any change that affects eligibility. 5.3 Jobs. Job offers are made through the Platform and may be accepted or declined. Once accepted, the Engineer must attend at the scheduled time, perform the work described in the job scope to a professional standard, follow reasonable site and safety requirements, and complete customer sign-off in the app before leaving. Repeated no-shows, late cancellations, or quality failures may lead to reduced job allocation, suspension, or removal from the network. 5.4 Payment. Engineers are paid by WorkTech per completed job at the rates shown when the job is offered, following customer sign-off and any quality verification. Payment timing and methods are as notified through the Platform. WorkTech may withhold or reclaim payment for jobs that are incomplete, falsified, or subject to a substantiated workmanship complaint, pending resolution. 5.5 Ratings and quality. Every job includes a customer rating at completion. Ratings, completion data, and complaint history form the Engineer's quality record, which we use for dispatch decisions and network management. 5.6 Conduct. Engineers must behave professionally and courteously with End Customers, must not solicit work from End Customers or Partners off-platform for jobs introduced through the Platform, and must not misrepresent their relationship with WorkTech or any Partner. 5.7 Remediation. Where a workmanship defect is confirmed on a job, the Engineer will, where reasonably practicable, be offered the opportunity to re-attend and remedy it before the job is reassigned. 6. Terms for End Customers 6.1 Your booking. Your installation is arranged through the WorkTech platform, usually in connection with a purchase from one of our retail or manufacturer partners. Your purchase contract for the product remains with the retailer; the installation service is fulfilled through WorkTech's network of vetted, insured engineers. 6.2 Appointments and access. Please ensure someone aged 18 or over is present for the appointment, the installation area is reasonably accessible, and you tell us in advance about anything relevant to the work (for example wall type, access restrictions, or parking). If we cannot reasonably access the property or carry out the work as scoped, the visit may be rescheduled and a reasonable rearrangement charge may apply where notice was not given. 6.3 Changes and cancellations. You can reschedule or cancel through the contact details in your booking confirmation. We ask for at least 48 hours' notice where possible. 6.4 Completion and sign-off. At the end of the job the engineer will ask you to inspect the work and confirm completion with a rating. Please raise anything you are not happy with at that point where possible. 6.5 If something goes wrong. If you discover a problem with the installation workmanship, contact us within 30 days of completion at info@work-tech.co.uk or 07957 014082 and we will investigate. Where a workmanship defect is confirmed, we will re-attend and put it right at no cost to you. This does not affect any rights you have against the retailer in relation to the product itself, and nothing in these terms affects your statutory rights. 6.6 Product issues. Faults with the product you purchased (rather than the installation) are a matter for the retailer or manufacturer under your purchase contract and warranty; we will point you to the right contact where we can. 7. Intellectual property The Platform, its software, design, and content are owned by WorkTech and/or its licensors within the IWG Group. You receive only the limited right to use the Platform for its intended purpose while these terms apply to you. Partner logos and materials remain the property of their owners. 8. Availability and changes We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may carry out maintenance (scheduled outside peak hours where practicable), and we may update features and these terms from time to time. Material changes will be notified through the Platform or by email; continued use after notice constitutes acceptance. 9. Liability Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — and nothing in these terms affects End Customers' statutory rights. Subject to that: for business users, liability is governed by the commercial Terms & Conditions and any Order Form; for Engineers, WorkTech's liability is limited to amounts properly payable for completed jobs; and the Platform is provided "as is" for general availability, without warranty of uninterrupted or error-free operation. 10. Suspension and termination We may suspend or terminate Platform access for breach of these terms, suspected fraud or misuse, legal requirement, or risk to the security of the Platform or the safety of any person. Engineers may leave the network at any time by written notice, subject to completing accepted jobs. Sections relating to intellectual property, liability, conduct, and data protection survive termination. 11. General These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that End Customers who are consumers may bring proceedings in their local courts where the law allows. If any provision is found unenforceable, the rest remains in effect. These terms, together with any applicable commercial agreement and Part B below, are the entire terms for use of the Platform. Part B — Privacy Notice This notice explains how WorkTech Global Limited handles personal data in connection with the Platform and our services, in accordance with the UK GDPR and the Data Protection Act 2018. It is addressed to all users: partners and their staff, engineers, end customers, and website visitors. 1. Who is responsible for your data WorkTech Global Limited (Company No. 15151466) is the data controller for personal data relating to website enquiries, Platform accounts, engineers, and our own business contacts. Where a retail or manufacturer partner submits its customers' details to us so we can arrange an installation, the partner is the controller and WorkTech processes that data on the partner's behalf as processor. What we collect, and why — by user type 2.1 End Customers We process your name, address, contact details, order reference, product and installation details, appointment information, job status and completion records, your rating and any comments, and related communications. We use this to schedule and complete your installation, communicate with you about your appointment, manage quality, and resolve any issues. Lawful bases: performance of the installation arrangement and our legitimate interests in operating a reliable, evidenced service; where we act for a partner, we process on the partner's documented instructions. 2.2 Engineers We process your name, contact details, service areas, skills and certification evidence, insurance documents, identity verification records, bank details for payment, job history, customer ratings, and quality records. We use this to vet you, allocate jobs, pay you per completed job, manage quality and safety, and meet tax and legal record-keeping duties. Lawful bases: performance of our contract with you, legal obligation, and legitimate interests in network quality and customer safety. 2.3 Partners and Authorised Users We process business contact details, account credentials, role information, and Platform activity logs to provide and secure the service, manage the commercial relationship, invoice, and support you. Lawful bases: performance of a contract, legal obligation (accounting), and legitimate interests. 2.4 Website visitors and enquiries We process the details you submit through our contact form (name, email, company, interest, message, source page) and technical data such as IP address and browser information from server logs and anti-spam controls. Lawful bases: legitimate interests in responding to business enquiries and protecting our systems, and steps taken prior to entering a contract. 3. Who we share data with We share personal data only where necessary: job details with the assigned engineer to complete the work; job, status, and rating information with the partner whose channel the job came through; service providers (hosting, email delivery, telephony/SMS, payment processing, analytics) acting under contract on our instructions; IWG Group companies for internal administration; professional advisers and insurers where needed; and authorities where required by law. We do not sell personal data and do not share it with third parties for their own marketing. 4. International transfers We store data in the UK or EEA wherever possible. Where a provider processes data outside the UK/EEA, we use UK adequacy regulations, the UK International Data Transfer Agreement or Addendum, or another lawful safeguard. 5. Security We use encrypted connections (HTTPS/TLS), role-based access controls so each organisation and user sees only their own data, hashed credentials, spam and abuse controls on public forms, restricted access to lead and job records, and periodic review of access rights. If a breach occurs that is likely to result in a high risk to you, we will inform you and the ICO as the law requires. 7. Your rights You have the right to: access your personal data; have inaccurate data corrected; have data erased in certain circumstances; restrict processing in certain circumstances; object to processing based on legitimate interests and to direct marketing at any time; and data portability where processing is automated and based on contract or consent. Contact info@work-tech.co.uk to exercise any right; we respond within one month and may need to verify your identity. Where we process your data on a partner's behalf, we will route your request to that partner and assist them in responding. You can also complain to the Information Commissioner's Office (ico.org.uk · 0303 123 1113), though we would welcome the chance to resolve concerns directly first. 8. Cookies The Platform uses strictly necessary cookies for login sessions and security. Where non-essential cookies (such as analytics) are used on our websites, we ask for consent through a cookie notice, and you can withdraw consent at any time through the notice or your browser settings. 9. Automated matching Job dispatch uses automated matching based on skills, certification, and location. This is operational allocation, does not produce legal or similarly significant effects on individuals, and is not automated decision-making of the kind restricted by Article 22 UK GDPR. 10. Children Our services are directed at businesses and adult householders. We do not knowingly collect personal data from anyone under 18, except where household details are incidentally included in job information. 11. Changes to this notice We may update this notice from time to time. The version and date on the cover show the current edition. Material changes will be notified through the Platform or by email to account holders.
